Rules & Regulation

 

  1. Name of the society: The name of the society shall be state nursery men welfare association, Delhi .
  2. Membership: The membership of the society is open to any person who has attained the age of majority and has interest in the Nursery business and the development of the association, and abides by the rules and regulations of the association, without discrimination of the religion, caste, colour, and creed but subject to the approval of the governing body. The governing body of the eminent person as patron of the association/ society.
  3. Subscription: The rate of subscription for all the members shall be Rs. 1100/- for lifetime and fees Rs. 200/- for one year.
  4. Refusal: The governing body of the society may refuse any person for the membership provide reasons for refusal shall be communicated to the person concerned in writing with reason.
  5. Termination: The governing body of the society may terminate and member from the society on the following grounds :-
    1. On his/her death.
    2. If the member fails to pay the timely subscription fees continuously for one year from the due date of paying the subscription.
    3. If the member works against the aims and objects of the society.
    4. If the member tenders his/ her registration.
    5. By no confidence motion by two third majority of votes in the governing body.

      The reason of termination shall be communicated to the concerned members. Every such expelled member shall have right to appeal before the general body which may or may not be accepted.
  6. Appeals: All the appeals shall be preferred to the constituted committee consisting of 5 members as appointed by the governing body of the society, the decision of the constituted committee shall be final. The reason for the rejection shall be communicated to the member concerned. This clause will be applicable to the termination clauses.
  7. Re-Admission: In case of member expelled by the general body the same person can be readmitted provided the member concerned pays all up to date dues. The decision of the general body shall be final. This clause will be applicable for termination clause.
  8. Rights and privileges of the member: Every member shall have rights to participate in the general body meeting and shall also be entitled to inspect the records of the society with prior approval of the governing body. Besides. This he/she shall have also right to vote in the meeting of the society. Every member shall entitle to participate in the meetings, functions and get together programmes of the society. To inform the society pertaining to any matter of the society.
  9. General Body: There shall be a general body of the society consisting of all the members. The meetings of the general body shall be held after every one tear with 2/3 quorum. No quorum shall be required in the adjourned meetings. An emergent meeting of the general body may also be summoned on the written request of 3/5 members, with ten days prior notice for such meetings. The notice period of general body meeting shall be fifteen days. The following business shall be transacted in these meetings:-
    1. To prepare annual programme and policies.
    2. To discuss & to decide all such other matters and issues which are directly or indirectly related to the affairs of the society.
    3. To pass annual budget of the society.
    4. To appoint a qualified auditor of the society's funds.
    5. To consider any business brought forward by the governing Body.
  10. Governing Body: There shall be a governing body of the society to look after & to manage the day to day affairs of he society. It shall consist of minimum 7 and maximum 11 members including the office bearers. The meeting of the governing body shall be held after every 2 months with 2/3 quorum. No quorum required in the adjourned meeting. An emergent meeting of the governing body may also be summoned on the written request of 3/5 members by five day notice of the meeting. The notice period of the governing body shall be ten days. The following business shall be translated in these meetings:-
    1. To take necessary steps for the implementation of all the programes and policy drawn by the general body.
    2. To pass the necessary expenditure to meet the day to day requirements of the society.
    3. To take decision on application for membership.
    4. To appoint committee for disposal of any business of the society or for advice in any matter pertaining to the society.
    5. To arrange, finance if required from other bank(s), institutions or individual on reasonable terms and conditions and the governing body as a whole is liable for its return.
    6. To appointment, terminate & fix duties of any staff.
    7. To receive, to have custody of and to expand the funds of the society and manage the properties of the society.
    8. To sue and defend all legal proceedings on behalf of the society.
    9. To take all such other legal steps which may appear beneficial for the smooth & better management of the society.
    10. The following is the present structure of the governing body.

  11. Office Bearers and their Duties: -
    1. President :-
      1. He/ She shall preside over all the meetings of the general body and governing body.
      2. In case of equality of votes in any meeting he/she tender his/her casting vote
      3. He/she supervise work of other office bearer time to time.
      4. To take any urgent step on emergency for the development of the association.
    2. Vice President : In the absence of the President, the Vice President shall enjoy all the powers and duties which are entrusted to President. He/She will also assist to the president in his/her duties from time to time.
    3. General Secretary :
      1. He /she shall represent the society in all public and private offices.
      2. He/she shall keep all types of record of the society including the registration of members containing there in the names, addresses and other brief particulars.
      3. He/she undertake all types of correspondences on behalf of the society.
      4. He/she shall convince the meetings of general body, governing body & he/she shall also inform every member regarding time, date & place of the meetings through ten day earlier written notice.
    4. Treasurer: He/she shall collect subscriptions, gifts, grants-in-aid and donations from the member and general public and he/she also be responsible for keeping and maintenance of a true and correct accounts of the society's funds.
    5. Joint Secretaries: In the absence of the General Secretary, one of the joint secretaries shall enjoy all powers and duties which are entrusted to the General Secretary. They will also assist the General Secretary in his/her duties from time to time.
  12. Financial Year : The financial year of the society shall be from 1 st April to 31 st March every year.
  13. Source of Income and Utilization: Subscription, donations, grants-in-aid and gifts from the members and the general public shall be the sources of income of the society. All the income of the society shall be utilized towards the aims and objects of the society.
